To be considered fixed, a work must exist for more than a transitory duration. The term "transitory duration" is not defined in the 1976 Copyright Act.
In Triad Systems Corp. v. Southeastern Express Co.,[1] the court said that "[t]ransitory duration is a relative term that must be interpreted and applied in context."
