Overview[]

This working document complements Opinion 08/2001 on the processing of personal data in the employment context and contributes to the uniform application of the national measures adopted under the Directive 95/46/EC of the European Parliament and of the Council of 24 October 1995 on the protection of individuals with regard to the processing of personal data and on the free movement of such data. It does not prejudice the application of national law in related areas to data protection.

The Article 29 Working Party has set up a subgroup to examine this question and has adopted an extensive document which can be found here.

The Article 29 Working Party has examined in this working document the issue of the monitoring and surveillance of electronic communications in the workplace, in other words, the monitoring by the employer of e-mail and Internet use by employees.
